SimpCustoms provides a cloud-based software platform designed to assist users in creating, managing, and preparing customs-related documentation. Features may include document generation, AI-assisted data extraction, and profile management tools.

SimpCustoms is a self-service software platform and does not act as a customs broker, freight forwarder, or legal advisor.

3. Subscriptions, Billing & Payments

Access to the Service requires a paid subscription unless otherwise stated.

Subscriptions:

• Are billed on a monthly or annual basis, depending on the plan selected
• Include usage limits based on the selected plan
• Automatically renew unless cancelled before the end of the billing period

You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.

Refund Policy

• Except where required by law, all payments are non-refundable.
• No refunds are provided for partial billing periods, unused time, or changes of mind.

If you are a consumer located in the UK or EU, you may have a statutory right to cancel within 14 days. By accessing or using the Service during this period, you acknowledge that you request immediate access and understand that your right to cancel may be waived.

4. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms.

You must not:

• Violate any applicable laws or regulations
• Upload malicious code or attempt to breach platform security
• Use the Service to create fraudulent, misleading, or unlawful documents
• Share account credentials or provide access to unauthorised users
• Reverse engineer, copy, scrape, or attempt to replicate the Service

5. User Responsibilities

You are solely responsible for:

• The accuracy and completeness of all information you enter
• Reviewing, validating, and approving all generated documents
• Ensuring documents comply with applicable customs, trade, and regulatory requirements
• Maintaining the confidentiality and security of your account credentials

You acknowledge that documents generated using the Service must be reviewed before submission to any authority.

6. No Legal, Customs, or Brokerage Advice

• Legal advice
• Customs brokerage services
• Freight forwarding services
• Regulatory or tax advice

While we aim to support document preparation, final responsibility for compliance remains with the user. You should consult licensed customs brokers, freight forwarders, or legal professionals where required.

7. AI & Automation Disclaimer

Certain features of the Service may use automated or AI-assisted processes.

You acknowledge that:

• AI-generated outputs may contain errors or omissions
• AI features do not guarantee regulatory compliance
• All AI-assisted results must be independently reviewed by you before use

SimpCustoms makes no guarantees regarding the accuracy or suitability of AI-generated content.

8. Regulatory & Customs Compliance Disclaimer

Customs laws, HS classifications, documentation requirements, and enforcement practices vary by jurisdiction and may change without notice.

You are solely responsible for ensuring compliance with all applicable laws and regulations in the origin, transit, and destination countries.

9. Service Availability

The Service is provided on an "as available" basis. We do not guarantee uninterrupted or error-free operation and may perform maintenance, updates, or changes that temporarily affect availability.

We are not liable for delays, outages, or interruptions beyond our reasonable control.

10. Limitation of Liability

To the maximum extent permitted by law:

• The Service is provided "as is" and "as available"
• We disclaim all warranties, express or implied
• We are not liable for indirect, incidental, or consequential losses, including customs penalties, fines, lost profits, or shipment delays
• Our total liability shall not exceed the total fees paid by you to SimpCustoms in the 12 months preceding the claim

All intellectual property rights in the Service, including software, content, branding, and functionality, are owned by SimpCustoms or its licensors.

You retain ownership of any data you upload, subject to our right to process it for the purpose of providing the Service.

12. Termination

We may suspend or terminate your access to the Service if you breach these Terms or engage in fraudulent or unlawful activity.

Upon termination:

• Access to the Service will cease
• Data may be deleted in accordance with our data retention policies
